Introduction

Welcome to BVUNZO ("the Platform," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the BVUNZO website, platform, and related services (collectively, "the Service").

By registering for, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

Eligibility

By using the Service, you represent and warrant that:

You are at least 13 years of age (or the age of digital consent in your jurisdiction)
You have the full power and authority to enter into this agreement
You are not located in a country that is subject to embargo or sanctions
You have not been previously suspended or removed from the Service

If you are using the Service on behalf of an educational institution or organization, you represent that you have authority to bind that organization to these Terms.

Account Registration and Security

3.1 Account Creation

To access the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Responsibility

You are solely responsible for:

Maintaining the confidentiality of your login credentials
All activities that occur under your account
Notifying us immediately of any unauthorized use of your account

3.3 Account Types

The Service offers the following account types:

Student accounts for individual learners, including independent self-study
Teacher accounts for educators
Admin accounts for authorized platform administrators

3.4 Account Suspension and Termination

We reserve the right to suspend or terminate your account if:

You violate these Terms
Your account is inactive for an extended period
We suspect unauthorized or fraudulent activity
Required by applicable law

Exam Board Selection and Content Filtering

4.1 Board Selection

During registration, you must select your exam board preference: ZIMSEC, Cambridge, or Both. This selection determines which content is displayed to you.

4.2 Content Appropriateness

While we strive to match content to your selected board, we do not guarantee that all displayed content perfectly aligns with your specific syllabus. Users should verify content relevance with their official curriculum.

4.3 Administrative Access

Platform administrators may access content from all exam boards for moderation and quality assurance purposes.

User Conduct and Content

5.1 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

Use the Service in any way that violates applicable laws or regulations
Impersonate any person or entity
Attempt to gain unauthorized access to any part of the Service
Interfere with or disrupt the Service or servers
Use the Service to transmit harmful code or materials
Share your account credentials with others
Attempt to circumvent any technical measures we use to provide the Service

5.2 User-Generated Content

The Service allows you to post content, including:

Forum posts and replies
Question comments
Feedback submissions

You retain ownership of your content, but you grant us a worldwide, royalty-free license to host, store, and display this content on the Service.

5.3 Content Moderation

All user-generated content is subject to moderation. We reserve the right to:

Review all comments and forum posts before publication
Reject or remove any content that violates these Terms
Report inappropriate content to relevant authorities
Suspend accounts that repeatedly violate content standards

5.4 Prohibited Content

You may not post content that:

Is defamatory, obscene, or offensive
Infringes on intellectual property rights
Contains personal information of others without consent
Promotes discrimination or harassment
Contains spam or commercial solicitation
Impersonates others or provides false information

Intellectual Property Rights

6.1 Platform Ownership

The BVUNZO platform, including its code, design, layout, and functionality, is owned by us and protected by copyright, trademark, and other intellectual property laws.

6.2 Question Bank and Educational Content

The questions, answers, solutions, and educational materials on the Platform are:

Either owned by us or used with permission
Provided for personal educational use only
Not to be reproduced, distributed, or sold without permission

6.3 User Data and Progress

Your progress data, including attempt history, performance metrics, and assessment results, belongs to you. We use this data to provide and improve the Service.

6.4 Feedback and Suggestions

If you provide feedback or suggestions about the Service, you grant us the right to use such feedback without compensation or obligation to you.

Privacy and Data Protection

7.1 Privacy Policy

Our Privacy Policy, incorporated by reference, explains how we collect, use, and protect your personal information. By using the Service, you consent to our data practices described in the Privacy Policy.

7.2 Data Collection

We collect and process:

Account information (name, email, username)
Demographic information (age, gender, educational level)
Exam board preferences
Usage data (questions attempted, answers submitted, progress metrics)
Device and browser information

7.3 Data Security

We implement reasonable security measures to protect your data, including encryption, secure authentication protocols, regular security assessments, and access controls. However, no method of transmission over the Internet is 100% secure, and we cannot guarantee absolute security.

7.4 Data Retention

We retain your data for as long as your account is active or as needed to provide the Service. When you delete your account, we create a DeletedAccount record for audit purposes before removing your personal information.

7.5 Children's Privacy

The Service is not directed at children under 13. If we learn that we have collected personal information from a child under 13 without parental consent, we will delete that information.

Payment and Subscriptions

8.1 Free Access

BVUNZO currently offers free access to core features. We reserve the right to introduce paid features or subscriptions in the future with advance notice to users.

8.2 Future Paid Services

If we introduce paid services:

Pricing will be clearly disclosed
Payment will be processed securely through third-party providers
Subscription terms will be provided at that time
You will have the option to cancel before being charged

Third-Party Services

9.1 External Links

The Service may contain links to third-party websites or services. We are not responsible for the content or practices of these third parties.

9.2 Third-Party Integrations

We may use third-party services for email verification, analytics, and AI-assisted solutions (via OpenRouter). Your use of these services is subject to their respective terms and privacy policies.

Modifications to the Service

10.1 Service Updates

We continually improve the Service and may add or remove features, update content, modify the user interface, or change functionality.

10.2 Notice of Changes

We will provide reasonable notice of significant changes that may affect your use of the Service.

10.3 Temporary Suspensions

We may temporarily suspend the Service for maintenance, updates, or emergencies. We will attempt to minimize disruption and provide advance notice when possible.

Termination

11.1 Termination by You

You may terminate your account at any time by using the account deletion feature in Settings or contacting us to request deletion. Upon termination, your account will be deactivated and your personal information will be removed in accordance with our Privacy Policy.

11.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice, if you violate these Terms or for other reasons including extended inactivity, suspicious activity, or legal requirements.

11.3 Effect of Termination

Upon termination, your access to the Service ceases, your user content may be removed, and sections of these Terms intended to survive termination shall continue.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CONTENT WILL BE ACCURATE OR RELIABLE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BVUNZO, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, OR DAMAGES RELATED TO YOUR USE OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

Indemnification

You agree to indemnify and hold harmless BVUNZO and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the Service, your violation of these Terms, your violation of any third-party rights, or your user-generated content.

Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by the laws of Zimbabwe, without regard to its conflict of law provisions.

15.2 Dispute Resolution

Any disputes arising under these Terms shall first be attempted to be resolved through good-faith negotiations. If negotiations fail, disputes shall be resolved in the courts of Harare, Zimbabwe.

15.3 Class Action Waiver

You agree to resolve disputes on an individual basis and waive the right to participate in class actions.

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting notice on the Platform, sending email to your registered address, or requiring acknowledgment of updated Terms. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

Miscellaneous Provisions

17.1 Entire Agreement

These Terms constitute the entire agreement between you and BVUNZO regarding the Service.

17.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

17.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.

17.4 Assignment

You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.

17.5 Force Majeure

We shall not be liable for delays or failures in performance resulting from causes beyond our reasonable control.
